RIGHT OF WITHDRAWAL
According to the art. 52 of the legislative decree 6 September 2005 n. 206 ("Consumer Code"), you have the right to withdraw from the contract signed with the Seller without any penalty and without giving any reason, within thirty (30) days from the day you received the products purchased on Ushop.it. According to the art. 54 of the Consumer Code, the right of withdrawal may be exercised by completing the appropriate form in the Post-Sales section of the site. The Seller will send you confirmation by e-mail of receipt of the request for withdrawal. Each returned item must be accompanied by a Return Form that will be sent to you by e-mail from Customer Service.
In this case, the items must be sent by courier indicated by Ushop (BRT) using the prepaid waybill that will be provided by Customer Service via email. Returns that are part of orders shipped outside Italy are subject to payment of shipping costs by the customer, except for defective items. In some specific cases, duly reported in the Return Form, it will be possible to change the chosen item with another.
According to the art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased custom-made or customized products or sealed goods that do not lend themselves to being returned for hygienic reasons or related to health protection and have been opened after delivery.
I. Conditions for exercising the right of withdrawal pursuant to art. 52 of the Consumer Code
The right of withdrawal is considered exercised correctly if the following conditions are fully met:
• within thirty (30) days of receipt of the products, you will need to correctly fill out and submit the form you find in the Post area;
• the products must not have been used, worn, washed or damaged;
• the identification tag must still be attached to the products;
• the products must be returned in their original undamaged packaging;
• the products must not be damaged.
If you have complied with all the required conditions, Ushop pursuant to art. 56 of the Consumer Code will reimburse you in full the price of the products purchased, with the exception of any shipping costs, cash on delivery, gift packages and other additional expenses that you paid at the time of the order. In the event that you decide to use a shipper other than the one indicated by Ushop, you will have to pay the return costs in first person.
You will be contacted if your return cannot be accepted because it does not comply with the conditions listed above in the previous paragraph. In this case, you can choose whether to accept the rebate deduction, which will be communicated to you, due to the decrease in value of the returned products, or if you get back the products purchased at your expense.
If you refuse this shipment Ushop reserves the right to withhold the products and the amount indicated for the rebate deduction, due to the decrease in value of the returned products.
II. Repayment times and methods
According to the art. 56, paragraph III of the Consumer Code, only after Ushop has received your return and checked that all the requirements have been met, you will receive an e-mail confirming the return acceptance and Ushop will proceed with the full refund, or, if it is once there is a decrease in the value of the returned products, you will receive an e-mail in which you will be notified of the amount deducted as a rebate deduction and Ushop will reimburse the amount due. Whatever method of payment you use (Paypal / credit card, bank transfer, cash payment on delivery), the refund is activated by Ushop in the shortest possible time, and in any case within thirty (30) days from the date on which it is became aware of the exercise of your right of withdrawal, once verified that the withdrawal occurred in compliance with the above conditions.
The actual time for the re-credit or the return of the amounts you paid for the purchase of the products depends on the payment methods used:
• purchase through PayPal: the refund will be made to your PayPal account and will be immediately visible. The actual repayment on the credit card from your PayPal account depends on the institution that issued the card.
• Bank transfer: our bank will refund within 7 working days from the date of sending our confirmation e-mail. You can check the refund on your account online or by contacting your bank.
• cash payment on delivery: the reimbursement takes place on the current account indicated by you, therefore the repayment time depends on the correctness of the data you enter and on the credit institution where you opened the account. In this case, the refund will not include any costs charged for cash payment on delivery.
In the event of a gift, the reimbursement of the sums will be made against the person who made the payment.
If you wish, as an alternative to the refund on the PayPal account or on the current account indicated by you, when exercising the Right of Withdrawal, you can choose to receive the refund through a purchase voucher, in the form of a credit that will be displayed in the your account on Ushop.it, of the same value as the amounts to be reimbursed and which can be used for future purchases from the Ushop.it site.
The amount reimbursed will be credited when your return is accepted by the Seller and together with the issuance of the credit you will receive a confirmation e-mail which will also indicate the relative value.
The credits will be used both in full and in part, based on the value of the order and until exhaustion, to make purchases on the site Ushop.it.
III. Conditions for product changes
In some specific cases, duly reported, as an alternative to exercising the right of withdrawal, you will have the possibility to change the products purchased with others, instead of obtaining a refund of the relative price.
The change request will take place within the following limits:
• only those products purchased may be exchanged, for which this possibility will be expressly provided in the form in the After Sales section;
• you can request the exchange of one or more products purchased only with products of the same model, of different sizes and / or colors.
• you can request the exchange of one or more products purchased within and no later than thirty (30) working days from the date of their delivery, by filling in the form, to be sent electronically to Ushop within the aforementioned deadline.
• you can make only one change request for each product purchased;
• the products for which you request a change must be returned to Ushop in their original packaging and undamaged, unused, worn, washed or damaged, and the identification tag must still be attached.
• the products to be changed that are part of a single order must be sent to Ushop in a single shipment. Ushop, in fact, reserves the right not to accept products of the same order, sent for exchange at different times.
If all the conditions mentioned above are correctly met, once the form containing your change request has been filled in and sent, Ushop will take over the same replacement request by sending you a confirmation e-mail to this effect.
IV. Times and methods for obtaining the change
After the Ushop has received the products you wish to change and checked that all the above requirements have been met, Ushop will verify the actual availability in its warehouses of the products in the size and / or color you have selected.
In the event that the product or products selected for the change are not available in their warehouses, Ushop will not be able to accept your change request and will therefore refund the price of the product or products originally purchased and not replaceable, in accordance with what required by the Consumer Code and according to the procedures set out in section I and II of this information notice
In the event that the product or products selected for the change are available, Ushop will be able to accept your change request and will therefore send you an e-mail confirming that the replacement products have been shipped. The shipment will take place in this case within thirty (30) days from the date on which Ushop has become aware of your change request, once it has been verified that it has taken place in compliance with the conditions set out above in section III of this information notice. The shipping costs of the replacement products will be borne by Ushop, who will choose the relative carrier.
Where the price of the product purchased is lower than the price of the product selected for the exchange, no refund will be given for the difference.
You will be contacted in the event that your change request cannot be accepted because it does not comply with the conditions listed above in section III of this statement. In this case, you can choose to get back the products you intended to change at your expense. In the event that you refuse this shipment, Ushop reserves the right to retain the products and, also by using one of the hypotheses described above in section I of this information, it may also withhold the amount corresponding to the purchase price of the products, or the amount indicated for the rebate deduction, due to the decrease in value of the returned products.
The product or replacement products may be subject to subsequent return pursuant to art. 52 of the Consumer Code and in accordance with the provisions of the previous Sections I and II.
V. Product identification tag
All products offered for sale by Ushop are provided with an identification tag, which is an integral part of the good. We invite you to try the product without removing the tag. We also remind you that, pursuant to art. 57, paragraph II, of the Consumer Code, you will be responsible for the decrease in the value of the products returned to the Seller, consequent to a use of the products other than that necessary to ascertain their nature, characteristics and functioning.
VI. RETURN OF PRODUCTS
Returns can be sent via the courier indicated by Ushop, using the prepaid waybill that will be sent to you by e-mail from Customer Service, as well as defective items. This method will allow Ushop to pay, on your behalf, the shipment and to check at any time where your package is. In order to organize the collection of the products you wish to make contact the Customer Service. Alternatively, if you decide to use a courier other than the one indicated by Ushop for the return of the products, you will in any case have to pay the costs of the return yourself and will be responsible for the loss in case of loss. or damage to the products during transport.
VII. Consumer Code
These Conditions for exercising the right of withdrawal, which are an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code, Chapter I "of consumer rights in contracts".
